Privacy Policy for DARE: Special Provisions for California Residents (cpa)

These Special Provisions for California Residents supplement the DARE General Privacy Policy and apply solely to all visitors, users, and others who reside in the State of California ("consumers" or "you"). We adopt this notice to comply with the California Consumer Privacy Act of 2018 ("cpa") and any amendments, including the California Privacy Rights Act of 2020 ("CPRA").

Article 1: Information We Collect

In the preceding twelve (12) months, SystemMetrix Co., Ltd. has collected the following categories of personal information:

Article 2: Sources of Information

We collect the categories of personal information listed above from the following categories of sources:

  • Directly from you: From forms you complete or products and services you purchase.
  • Indirectly from you: From observing your actions on our website or within our software applications (e.g., license authentication logs).
  • Service Providers: From our authorized reseller, Paddle.com, regarding your transaction and billing status.

Article 3: Use of Personal Information

We may use or disclose the personal information we collect for "business purposes" or "commercial purposes" as defined in the General Privacy Policy (Article 2), including:

  • Auditing related to interactions with consumers.
  • Detecting security incidents and protecting against fraudulent activity.
  • Debugging to identify and repair errors (e.g., AI Search or conversion engine optimization).
  • Undertaking internal research for technological development.

Article 4: Disclosures of Personal Information for a Business Purpose

In the preceding twelve (12) months, we have disclosed the following categories of personal information for a business purpose to our Service Providers (including Paddle.com, hosting providers, and technical support tools):

  • Category A: Identifiers.
  • Category B: Personal Information categories.
  • Category C: Commercial Information.

Article 5: Sales and Sharing of Personal Information

Under the CCPA, "selling" information includes any transfer of personal information to a third party for monetary or other valuable consideration.

  • We do not sell your personal information for monetary compensation.
  • Cross-Context Behavioral Advertising: We may "share" identifiers (such as hashed email addresses or cookie IDs) with third-party advertising partners to provide you with relevant content. You have the right to opt-out of this sharing.

Article 6: Your Rights and Choices

The CCPA provides California residents with specific rights regarding their personal information:

  • Right to Know and Access: You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months.
  • Right to Delete: You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions (e.g., completing a transaction, detecting security incidents).
  • Right to Correct: You have the right to request that we correct inaccurate personal information.
  • Right to Opt-Out of Sale or Sharing: You have the right to direct us to not sell or share your personal information.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA rights.

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may only make a verifiable consumer request for access or data portability twice within a 12-month period.
